HKUAANC Event Notice, Assumption of Risk, Release & Participation Terms


Applies to all HKUAANC events, programs, activities, and related experiences (collectively, the “Event”), including but not limited to networking events, fireside chats, speaker sessions, wine tastings, winery visits, dining events, BBQs, hikes, outdoor activities, transportation between event locations (if any), cultural programs, and any on-site or off-site activities organized, hosted, sponsored, or facilitated by HKUAANC.


PLEASE READ CAREFULLY


By signing up, registering, purchasing tickets, RSVP’ing to, participating in, and/or attending an Event, you acknowledge that you have read and understood this notice and agree to the terms below.


1. Voluntary Participation


Participation in any Event is entirely voluntary.


Participants are solely responsible for determining whether participation is appropriate based on their own health, fitness, medical condition, dietary restrictions, transportation arrangements, personal circumstances, and comfort level.


2. Assumption of Risk


Participants acknowledge that Events may involve inherent and unavoidable risks, including but not limited to:

  • Slips, trips, falls, collisions, and accidents;
  • Consumption of food and beverages;
  • Consumption of alcoholic beverages;
  • Allergic reactions and food-related illness;
  • Outdoor conditions including weather, uneven terrain, and environmental hazards;
  • Physical activities such as walking, hiking, recreational activities, or venue tours;
  • Transportation-related incidents before, during, and after participation;
  • Actions of other participants, vendors, venue operators, or third parties;
  • Personal injury, illness, emotional distress, property damage, theft, loss, or other unforeseen incidents.


Participants knowingly and voluntarily assume all risks associated with participation in the Event, whether known or unknown.


3. Alcohol Acknowledgment and Participant Responsibility


Certain Events may include alcoholic beverages.


  • If a participant chooses to consume alcohol, the participant acknowledges and agrees that:
  • Consumption is entirely voluntary;
  • The participant is legally permitted to consume alcohol;
  • The participant accepts full responsibility for alcohol consumption and personal conduct;
  • The participant will not drive or operate any vehicle while impaired;
  • The participant is responsible for arranging safe transportation where appropriate.


HKUAANC does not supervise, monitor, or control individual alcohol consumption.

Participants remain solely responsible for their actions and decisions before, during, and after the Event.


4. Release and Waiver of Liability


In consideration for being permitted to participate in the Event, participants, on behalf of themselves and their heirs, successors, representatives, and assigns, release, waive, discharge, and agree not to assert claims against HKUAANC and its current and former officers, directors, board members, committee members, volunteers, employees, speakers, event organizers, sponsors, venue owners and operators, hosts, affiliates, and related parties (collectively, the “Released Parties”) for claims, liabilities, damages, costs, expenses, or losses arising out of or relating to participation in the Event.


This release includes claims arising from ordinary negligence of the Released Parties to the fullest extent permitted under applicable law.

This release does not apply to claims resulting from gross negligence, reckless conduct, intentional misconduct, or liabilities that cannot legally be waived.


This release applies to claims involving personal injury, illness, death, property damage, economic loss, and incidents occurring before, during, or after participation where connected to Event participation.


5. Participant Conduct and Personal Responsibility


Participants agree to:

  • Comply with applicable laws and venue rules;
  • Conduct themselves safely and respectfully;
  • Exercise reasonable judgment during participation;
  • Supervise any guests, dependents, or minors they bring;
  • Safeguard personal belongings.


HKUAANC reserves the right to refuse participation or remove attendees whose conduct creates safety concerns or materially disrupts the Event.


6. Limited Indemnification


Participants agree to indemnify and hold harmless the Released Parties from third-party claims, losses, damages, or expenses (including reasonable legal fees) arising directly from the participant’s unlawful acts, intentional misconduct, or material violation of these terms during participation in the Event.


7. Photography and Media


Events may be photographed, filmed, or recorded for alumni communications, historical archives, promotional materials, and future community engagement purposes.


By attending an Event, participants consent to the use of their likeness, image, voice, and appearance for such purposes unless written notice is provided in advance.


8. Emergency Assistance


If emergency assistance becomes reasonably necessary during an Event, participants authorize organizers to seek emergency response on their behalf.


Participants remain responsible for any resulting medical, transportation, or related expenses.


9. Acceptance of Terms


By signing up, registering, purchasing tickets, RSVP’ing to, participating in, and/or attending an Event, participants acknowledge and agree that:


  • They have read and understood this Event Notice, Assumption of Risk, Release & Participation Terms;
  • Participation is voluntary;
  • They assume responsibility for participation and personal decisions, including alcohol consumption and transportation;
  • They agree to the release and limitations described above; and
  • Participation constitutes acceptance of these terms.


If a participant does not agree to these terms, they should not register for or attend the Event.
